RE: The tariff classification of a porcelain briquettes from China

Dear Ms. Dorfman:

In your letter dated March 7, 2006, on behalf of your client, Modern Home Products, you requested a tariff classification ruling. Representative samples were submitted and will be returned to you as requested.

The submitted samples, designated in your brochure as item number BQ3A, are self-cleaning porcelain briquettes that will be used exclusively in an outdoor grill. The briquettes function as a heat barrier between the burner and the cooking grids.      You indicated in your letter whether this product is subject to quota. This merchandise is not subject to quota restraints or visa requirements.

The applicable subheading for the porcelain briquettes will be 6914.10.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other ceramic articles: of porcelain or china: other. The rate of duty will be 9 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
